Terms of Service – Archihub

Welcome to Archihub.

These Terms of Service (“Terms”) govern your access to and use of Archihub.io, related applications, marketplace features, communications, payment tools, professional profiles, project management features, and other products or services made available by Archihub (collectively, the “Platform”).

Archihub is operated by Acostudio, Inc. (“Archihub,” “we,” “us,” or “our”).

By accessing the Platform, creating an account, submitting a project or proposal, purchasing a service or membership, or otherwise using Archihub, you agree to these Terms and our Privacy Policy.

If you do not agree to these Terms, you may not use the Platform.

1. The Archihub Platform

Archihub is a digital marketplace and professional network designed to connect property owners, businesses, institutions, government entities, architects, designers, engineers, specialists, organizations, and other professionals involved in architecture, design, construction, visualization, planning, engineering, and related industries.

Users may use Archihub to:

create and publish professional or organizational profiles;
display portfolios, experience, qualifications, services, and credentials;
discover professionals and organizations;
search by profession, discipline, service, expertise, or location;
post projects or opportunities;
submit proposals;
communicate with other users;
enter into project engagements;
fund or receive payments through available payment tools;
manage certain project-related activities;
provide ratings and reviews;
access memberships, marketplace features, or other services offered by Archihub.

Certain services, including Archi-Shop, gift cards, applications, memberships, promotional programs, or future products, may be subject to additional terms presented at the time of use or purchase.

2. Archihub Is a Marketplace, Not the Professional Providing the Service

Unless Archihub expressly states otherwise in writing, Archihub is not an architecture firm, engineering firm, contractor, design firm, employer, staffing agency, real estate professional, or provider of the professional services advertised by users of the Platform.

Providers offer their services independently.

Owners and Providers are responsible for determining whether they wish to enter into a professional or commercial relationship with one another.

Archihub does not become a party to the underlying professional services agreement between an Owner and Provider merely because the parties met, communicated, contracted, managed a project, or processed payment through the Platform.

Nothing in these Terms creates an employment, partnership, joint venture, fiduciary, franchise, or agency relationship between Archihub and any user.

3. Professional Licensing and Regulatory Requirements

Architecture, engineering, surveying, construction, and other professional services may be regulated differently depending on jurisdiction.

Providers are solely responsible for:

maintaining all licenses, registrations, certifications, permits, insurance, and professional qualifications required to perform their services;
accurately representing their credentials;
determining whether they are legally permitted to perform a particular service in a particular jurisdiction;
complying with applicable professional standards, building codes, permitting requirements, laws, and regulations.

An Archihub profile, badge, category, credential display, verification indicator, ranking, or search placement does not constitute a guarantee by Archihub that a Provider is licensed or qualified for a particular project unless Archihub explicitly states that a specific credential has been independently verified.

Owners should independently evaluate professional qualifications before engaging a Provider.

4. Eligibility

You must be at least 18 years old and legally capable of entering into binding contracts to create an account or conduct transactions through Archihub.

If you use Archihub on behalf of a company, organization, institution, public agency, or other legal entity, you represent that you have authority to bind that entity to these Terms.

5. User Accounts

You agree to provide accurate, complete, and current information when creating and maintaining your account.

You are responsible for:

maintaining the confidentiality of your credentials;
activity occurring through your account;
promptly notifying Archihub of suspected unauthorized access;
keeping your contact and professional information current.

You may not create accounts using false identities, impersonate another person or organization, or misrepresent your affiliation, credentials, qualifications, or professional status.

Archihub may require identity, payment, business, or professional verification when appropriate.

6. Owners

An “Owner” is a user who seeks professionals, organizations, services, or project assistance through Archihub. Owners may include individuals, businesses, developers, institutions, governmental entities, and other organizations.

Owners are responsible for providing accurate project information and for determining the appropriate scope, budget, schedule, contractual requirements, permits, insurance, intellectual property arrangements, and professional qualifications required for their projects.

Owners may not request unlawful services or encourage Providers to violate professional, licensing, safety, regulatory, or intellectual property requirements.

7. Providers

A “Provider” is a professional or organization offering services through Archihub.

Providers may include architects, designers, interior designers, urban designers, landscape architects, drafters, 3D artists, architectural photographers, lighting designers, structural engineers, surveyors, MEP professionals, specialists, firms, organizations, institutions, and other approved professional categories.

Providers are responsible for the accuracy of their:

professional titles;
portfolios;
work history;
licenses;
certifications;
education;
awards;
project descriptions;
rates;
availability;
organization information;
service descriptions.

Providers may only upload work they are authorized to display.

8. Projects, Proposals, and Professional Agreements

Archihub may provide tools for posting projects, submitting proposals, exchanging messages, defining milestones, sharing documents, or managing work.

These tools assist users but do not replace an appropriate professional services agreement.

Owners and Providers should separately establish any terms necessary for their engagement, including:

scope of services;
deliverables;
milestones;
schedules;
compensation;
reimbursable expenses;
revisions;
ownership of work product;
licensing rights;
confidentiality;
insurance;
professional liability;
permitting responsibilities;
termination rights;
dispute procedures.

Unless expressly stated otherwise, Archihub does not determine these contractual terms for users.

9. Payments

Archihub may enable payments through third-party payment processors.

Users authorize Archihub and its payment providers to process transactions, fees, refunds, transfers, payout information, and other payment-related activity necessary to operate the Platform.

Payment providers may require additional identity, tax, banking, or compliance information.

Archihub does not normally receive or store complete payment-card information when that information is collected directly by a payment processor.

Project Funding and Payment Holds

For eligible transactions, Archihub may provide milestone funding, delayed payout, wallet, payment-hold, or similar payment-protection functionality.

Funds may remain pending until applicable release conditions are satisfied.

Unless Archihub expressly identifies a transaction as using a legally established escrow service, these payment-hold features do not create an attorney escrow account, fiduciary escrow relationship, trust account, or regulated escrow service.

Release timing may depend on project status, user instructions, dispute status, payment processor requirements, chargebacks, security reviews, or other applicable conditions.

10. Platform Fees

Archihub may charge:

Provider service fees;
transaction fees;
subscription or membership fees;
listing or promotional fees;
payment-processing related charges;
other fees disclosed before purchase or transaction.

Applicable fees will be displayed through the Platform or associated pricing information.

Archihub may change its fee structure prospectively. Changes do not retroactively alter completed transactions unless required to correct an error, fraud, chargeback, or other legitimate payment issue.

Users are responsible for applicable taxes associated with their earnings, purchases, services, or transactions unless Archihub is legally required to collect or remit them.

11. Refunds, Cancellations, and Chargebacks

Refund or cancellation rights may depend on the type of service, project status, payment milestone, applicable agreement between users, Archihub policies, payment-provider requirements, and applicable law.

Users agree to attempt to resolve legitimate transaction issues through Archihub’s available dispute or support process before initiating an improper payment reversal or chargeback.

Archihub reserves the right to suspend accounts associated with fraudulent or abusive chargeback activity.

Nothing in these Terms limits refund or cancellation rights that cannot legally be waived.

12. Disputes Between Users

Archihub may provide tools to help Owners and Providers communicate about project or payment disagreements.

If Archihub reviews a dispute, it may consider information submitted through the Platform, including proposals, milestones, messages, files, payment records, and project activity.

Any decision by Archihub concerning release, refund, account status, or Platform access is an administrative Platform decision. It is not a professional determination of architectural, engineering, construction, legal, or technical liability.

Users remain responsible for resolving legal claims arising from their professional relationship.

13. User Content

“User Content” includes profiles, portfolio images, drawings, renderings, photographs, project descriptions, reviews, comments, messages, documents, videos, logos, and other material uploaded or submitted through the Platform.

You retain ownership of your User Content.

By making User Content available through Archihub, you grant Archihub a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, format, resize, transmit, and otherwise use that content as reasonably necessary to operate, promote, secure, and improve the Platform.

This license ends when the content is deleted from our systems, except where retention is reasonably necessary for backups, completed transactions, legal requirements, dispute records, security, or enforcement.

You represent that you have all rights and permissions necessary to upload and display your User Content.

You may not publish confidential client material, copyrighted works, project photographs, plans, renderings, trademarks, or other material unless you have permission to do so.

14. Ownership of Professional Deliverables

Archihub does not determine ownership of drawings, plans, models, renderings, photographs, designs, specifications, reports, intellectual property, or other deliverables created during a project.

Ownership and licensing rights should be established between the Owner and Provider in their professional agreement.

15. Reviews and Platform Integrity

Reviews and ratings must reflect genuine experiences.

Users may not:

purchase or sell reviews;
manipulate ratings;
create false engagements to generate reviews;
threaten another user to obtain a favorable review;
publish knowingly false or unlawful material.

Archihub may investigate and remove reviews that violate these Terms.

16. Prohibited Conduct

You may not use Archihub to:

commit fraud or deception;
impersonate another person;
misrepresent professional credentials;
violate licensing laws;
infringe intellectual property rights;
distribute malware or malicious code;
scrape or harvest Platform data without authorization;
interfere with Platform security;
harass, threaten, discriminate against, or abuse another user;
facilitate illegal activity;
manipulate payment systems;
create fraudulent transactions;
evade fees associated with transactions initiated through Archihub;
use another user’s information for unauthorized marketing or solicitation;
access accounts or systems without authorization.

17. Location Information

Archihub may allow users to identify their professional or project location and may provide geographic search or “near me” functionality.

Users control the accuracy of location information they submit.

Browser-based or device location features may require your permission.

Professional or organizational location information designated for public display may appear in profiles, search results, maps, or discovery features.

18. Third-Party Services

Archihub relies on third-party services that may include payment processors, mapping providers, cloud-hosting providers, analytics tools, communications platforms, security services, and embedded media.

Those services may be governed by their own terms and privacy policies.

Archihub is not responsible for independent third-party services outside its reasonable control.

19. Archihub Intellectual Property

The Archihub name, Platform design, software, interface, databases, original content, branding, logos, graphics, and other materials owned by Archihub or Acostudio, Inc. are protected by applicable intellectual property laws.

Except as expressly permitted, you may not copy, reproduce, modify, distribute, reverse engineer, sell, or commercially exploit Archihub intellectual property without authorization.

20. Copyright and Intellectual Property Complaints

If you believe material published on Archihub infringes your intellectual property rights, contact:

Please identify the protected work, the allegedly infringing material, its location on the Platform, your contact information, and sufficient information for us to evaluate the request.

Archihub may remove or restrict access to material that it reasonably believes violates intellectual property rights.

21. Suspension and Termination

Archihub may restrict, suspend, or terminate an account when reasonably necessary because of:

violations of these Terms;
fraud or security concerns;
payment abuse;
unlawful activity;
repeated intellectual property violations;
misrepresentation of professional credentials;
conduct creating material risk to users or the Platform;
legal or regulatory requirements.

Users may stop using Archihub at any time and may request account closure subject to outstanding transactions, disputes, financial obligations, and legally required retention.

22. Platform Availability

We work to maintain a reliable Platform but cannot guarantee uninterrupted or error-free operation.

Archihub may modify, suspend, replace, or discontinue features for maintenance, security, regulatory, operational, or product-development reasons.

23. Disclaimer of Warranties

To the fullest extent permitted by law, Archihub is provided on an “as is” and “as available” basis.

Archihub does not guarantee:

that a particular Provider will meet an Owner’s needs;
the quality or legality of services performed by users;
the accuracy of user-submitted information;
specific project outcomes;
continuous Platform availability;
employment, revenue, projects, clients, or business opportunities.

Nothing displayed through Archihub should be treated as architectural, engineering, legal, financial, permitting, construction, or other professional advice from Archihub itself.

24. Limitation of Liability

To the fullest extent permitted by applicable law, Archihub and Acostudio, Inc. will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from use of the Platform or transactions between users.

To the fullest extent permitted by law, the aggregate liability of Archihub and Acostudio, Inc. arising from the Platform will not exceed the greater of:

the amount of Platform fees actually paid by the claimant to Archihub during the twelve months immediately preceding the event giving rise to the claim; or
one hundred U.S. dollars (US $100).

These limitations do not apply where prohibited by law.

25. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Archihub, Acostudio, Inc., and their officers, employees, contractors, and affiliates from claims, damages, losses, liabilities, and reasonable costs arising from:

your violation of these Terms;
your User Content;
your professional services;
your project or transaction with another user;
your infringement of third-party rights;
your violation of applicable law.

26. Governing Law

These Terms are governed by the laws of the State of Florida, United States, without regard to conflict-of-law principles, except where applicable consumer law requires otherwise.

Unless otherwise required by applicable law, disputes involving Archihub or Acostudio, Inc. that cannot be resolved informally shall be brought before a court of competent jurisdiction in the State of Florida.

Nothing in this section prevents Archihub from seeking appropriate injunctive or equitable relief where necessary to protect the Platform, its users, or intellectual property.

27. Changes to These Terms

We may update these Terms when our services, business practices, legal obligations, or Platform features change.

The “Last Updated” date identifies the most recent revision.

If a change materially affects registered users’ rights or obligations, we may provide additional notice through the Platform or by email where appropriate.

Continued use of Archihub after revised Terms become effective constitutes acceptance where permitted by law.

28. Severability

If any portion of these Terms is determined to be invalid or unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.

29. Entire Agreement

These Terms, the Privacy Policy, and any additional terms presented for specific Archihub products or transactions constitute the agreement between you and Archihub regarding use of the Platform.
